EU caves in to car industry pressure to weaken NO2 emissions limits for diesel cars for years

EU governments have agreed to new limits for nitrogen oxide (NOx) emissions from diesel cars. The unexpected decision was taken by the European Commission’s Technical Committee on Motor Vehicles (TCMV). The bad news is that they are double the ‘Euro 6’ levels agreed back in 2007. The  EU has granted car-makers delays to a more stringent “real driving emissions” test, permitting them to emit  x2 the amount of NOx from 2019. The standard from 2021 is that all new cars will still be allowed to emit 50% more NOx than the Euro 6 limit of 80mg/km.  MEPs and campaigners were shocked at the cave-in to the lobbying of car-makers, by the EC, seeing it as a stitch-up by national governments. Only the Netherlands opposed the proposal, which passed after heavy lobbying from the car industry and EU countries such as the UK, Germany, France and Spain, which are currently facing court action from the EU for failing to meet NOstandards. “For car-making countries, it’s like dieselgate never happened,” said Greg Archer, the clean vehicles manager at the environmental think-tank T&E.  The Commission has argued that uncertainties in the testing method justify setting a higher long-term limit but this is likely to be legally challenged. The lower standards will make it even harder for a new SE runway to meet air pollution standards. The Heathrow area is often already in breach of legal limits.

Governments double and delay air pollution limits for diesel cars

EU governments have agreed to new limits for nitrogen oxide (NOx) emissions from diesel cars that are double the ‘Euro 6’ levels agreed back in 2007. They have also delayed the implementation of new limits for all new cars until 2019. From 2021, all new cars will still be allowed to emit 50% more NOx than the Euro 6 limit of 80mg/km.

The decision was taken today by national experts in the Technical Committee on Motor Vehicles (TCMV) after the European Commission unexpectedly agreed to substantially weaken its proposals. TCMV is supposed to agree only technical changes to regulations.

Greg Archer, clean vehicles manager at Transport & Environment, said: “Citizens will wonder why their governments would rather help carmakers that cheat emissions tests than give them clean air to breathe. This disgraceful and legally questionable decision must be rejected by the European Parliament. It seems governments would rather citizens die as a result of diesel exhaust emissions than require carmakers to fit technology typically costing €100.”

Changing EU air pollution legislation by this closed-door ‘comitology’ process is highly questionable legally. The Commission has argued that uncertainties in the testing method justify setting a higher long-term limit but this is likely to be legally challenged. The decision will also be scrutinised by the European Parliament that could reject the proposed limits as going beyond the powers of the Commission and member states.

Earlier this year the Commission started infringement procedures against the UK, Germany, France and Spain, for failing to meet NO2 standards. Yet these governments, plus those of Italy, Romania and Sweden among others, pushed for the Commission to weaken its proposals. It is now unclear how the countries will meet the required air pollution limits. Failure to do so may result in substantial fines. Only the Netherlands voted for stronger limits.

Greg Archer added: “For carmaking countries Dieselgate has never happened. Nitrogen dioxide pollution, mainly from diesel cars, causes premature deaths, asthma and birth abnormalities. It is shocking that governments are so keen to please carmakers and ignore the health effects of this invisible killer of over half a million citizens annually.”

Green MEPs describe newly minted test procedure, which will allow car manufactures to emit more than twice legal limit of NOx, as scandalous

The introduction of the tests has been delayed by a year by the European commission.

Revelations about Volkswagen’s use of “defeat devices” to manipulate current NOx tests and studies showing that just one in 10 cars meets current limits, appear to have had little effect on the voting.

Only the Netherlands opposed the proposal, which passed after heavy lobbying from the car industry and EU countries such as the UK, Germany, France and Spain, which are currently facing court action from the EU for failing to meet NO2standards.

The industry argues that the exemptions – known as conformity factors – were needed to prevent earnings shortfalls, and to reflect testing uncertainties. But MEPs and campaigners were shocked at what they saw as a cave-in by the European commission. “For carmaking countries, it’s like dieselgate never happened,” said Greg Archer, the clean vehicles manager at the environmental thinktank Transport and Environment.

“This is a disgraceful stitch-up by national governments, who are once again putting the interests of carmakers ahead of public health,” said the Liberal Democrat MEP Catherine Bearder.

NOx emissions can cause emphysema, bronchitis, heart disease and asthma. The government says NO2 is responsible for 23,500 premature deaths a year.

Most of Europe’s NOx pollution come from diesel engines, which were encouraged by the EU as a way of lowering planet-warming carbon dioxide emissions.

The International Council on Clean Transport, which uncovered the diesel emissions scandal, says that technologies to control both CO2 and NOx emissions from diesel cars already exist and are being deployed by some car manufacturers. But “a high conformity factor is indicative of poor emissions performance,” a paper by the group said last month.

If the tests used a factor of two, it would be “the first time that the Euro standards will be changed to raise an emission limit instead of lowering it,” the study said. The EU has chosen factors of 2.1 for 2019 and 1.5 for 2021.

The ICCT study added that emissions would anyway be considerably higher than indicated because the new test would not count emissions from cold-starts.

Green MEPs described the newly minted test procedure as scandalous and pledged to use all legal avenues to block it.

“This new test is being marketed as a ‘real driving emissions’ test but it is a sham,” said Dutch MEP Bas Eickhout. “It is instead a gift to car manufacturers who have made no effort to meet the EU’s car pollution rules. Governments are not only keeping their heads in the sand with regard to the ongoing car emissions scandal, but are also willing to ignore the major and growing public health problems linked to air pollution.”

UK, Germany and France lobbying for weakened cap on toxic car pollution

MEPs outraged as biggest three European countries push for watered down nitrogen oxide targets ahead of crucial EU vote

Europe’s biggest countries are lobbying for a proposed EU cap on nitrogen oxide (NOx) pollution from cars to be weakened in a vote on Wednesday, despite the VW diesel emissions scandal and revelations that 90% of cars do not currently meet pollution standards when on the road.

The UK has called for NOx emissions at twice the current legal maximum to be allowed until 2019, and for loopholes after that to permit emissions 40% above the European commission’s proposal of 80mg/km, the Guardian understands.

The British request was made in a paper submitted ahead of Wednesday’s decisive vote by a Brussels committee of national representatives.

Germany and France are pushing for similar targets, while other EU states support a drive by car manufacturers to delay implementation of the new rules for a year. Spain has held out for a start date three years later than that.

The Green MEP Bas Eickhout described the lobbying as “cynical and incomprehensible”. He said: “This is an outrage. We strongly urge the commission and EU governments to approve a test cycle that is based on real driving emissions, with no exemptions. The alternative would be a failure for Europe’s citizens.”

Earlier today, MEPs sitting in Strasbourg voted against any exemptions to the EU’s proposed NOx mandate, although their resolution is not binding.

The environmental thinktank Transport & Environment (T&E) said that the lobbying by big EU countries risked a permanent overshoot of the strict standard, due to come into force in 2017.

“Europe can’t afford to lose any more time,” said Greg Archer, of T&E. “We need to show determination, and stick to the rules agreed long ago.”

Some 23,500 people in Britain die prematurely from NOx emissions every year. The UK government is clear that the greatest contributor to illegal levels of NOx is the failure of vehicles to comply with regulations outside the testing lab.

The European commission proposal for the vote, seen by the Guardian, would allow emissions to be 60% over the current limit from 2017 when comes into force, and then falling to 20% after 2019. This would create a NOx cap of 95mg/km.

Diplomats say that the outcome of the vote, which will be decided by a qualified majority of national representatives on the technical committee for motor vehicles, is too close to call.

“Everything is possible,” one told the Guardian. “There could be some change to the commission proposal to try to find a qualified majority. It is still open.”

Car makers such as Fiat, Volvo and Seat argue that without leeway in the NOx targets, their revenues will be hit by having to pull existing vehicles from the market early. They also want to be given leeway after 2019 to reflect uncertainties in test measurements.

However, MEPs rejected their position today, passing a resolution by 493 votes to 145 calling for auto-manufacturers to be given no flexibility at all in meeting the 80mg/km NOx limit. The MEPs also appealed for emissions tests to be widened to include pollutants such as particulate matter and sulphur dioxide. An inquiry should be set up into the role played by national authorities in the VW scandal, they said.

Similar sentiments were expressed by some European countries at a meeting of environment ministers in Luxembourg yesterday.

“The car industry has a huge credibility problem which also affects our health and environment and the EU reputation,” said Carole Dieschbourg, Luxembourg’s environmental minister. “We need the new tests and better governance very soon.”
